By creating an account or using FormFlex, you acknowledge that you have read, understood, and agree to these Terms. You must be at least 13 years old to use FormFlex.

If you are using FormFlex on behalf of an organization, you represent that you have the authority to bind that entity to these Terms.

FormFlex is a fitness and recovery application that provides:

• AI-powered personalized workout and recovery plans
• Exercise tracking and progress monitoring
• Injury management and rehabilitation guidance
• Educational content and exercise demonstrations

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

To access FormFlex's features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or appear to be fraudulent.

The workout plans and recommendations provided by FormFlex are for informational and educational purposes only. They are generated by AI and may not be suitable for your specific health condition, fitness level, or medical history.

By using FormFlex, you acknowledge that:

• Physical exercise carries inherent risks of injury
• You assume full responsibility for your use of the App and any exercises performed
• FormFlex, Magna Collective LLC, and its affiliates are not liable for any injuries or health issues resulting from your use of the App

All content, features, and functionality in FormFlex—including but not limited to text, graphics, logos, code, and AI-generated workout plans—are owned by Magna Collective LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use FormFlex for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any part of the App without our express written permission.

Exercise demonstrations and videos may be sourced from third parties (e.g., YouTube, WGER). These are the property of their respective owners and subject to their own terms of use.

We reserve the right to suspend or terminate your account at any time, without prior notice, if:

• You violate these Terms
• You engage in fraudulent activity or trial abuse
• You fail to pay subscription fees
• Your account poses a security risk

You may also delete your account at any time through the App settings or by contacting us at cruz@magnacollective.dev. Upon termination, you will lose access to your data and any remaining subscription time.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• FormFlex is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied
• We do not guarantee that the App will be error-free, secure, or uninterrupted
• Magna Collective LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including injuries, loss of data, or loss of profits
• Our total liability for any claims arising from your use of FormFlex shall not exceed the amount you paid for the subscription in the past 12 months

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so these limitations may not apply to you.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you via:

• Email notification to your registered email address
• In-app notification
• Notice on our website

Your continued use of FormFlex after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and cancel your subscription.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of FormFlex shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
